Terms of Service

These terms

Upscale.tools is a product name of, and is operated by, Elowin Labs LLC. References to "Upscale.tools", "we" or "us" mean Elowin Labs LLC doing business as Upscale.tools. By using the site, creating an account or buying a plan, you agree to these terms. How we handle your information is described in the Privacy Policy and the Cookie Policy, which form part of these terms.

The service

The upscaler enlarges images with a neural network that runs in your browser, on your own device. It is free to use without an account, and an image you upscale while signed out is never sent to us.

A free account saves finished results, so you can open and export them again later. Pro adds batch upscaling and credit-funded image and video processing. Cloud HD uploads the file you choose and processes it through our cloud provider. The signed-out on-device tool remains free.

Results are produced automatically. Upscaling adds plausible detail that was not in the original, and it can get that detail wrong. Check every result before you rely on it, and do not present an upscaled image as an exact record of what was photographed.

Eligibility and accounts

You must be at least 13 years old to use Upscale.tools, or older where the law where you live requires it. The service is not directed at children under 13. To buy a plan you must be an adult, or have the permission of a parent or guardian who accepts these terms for you.

One account per person. Keep your sign-in details secure: you are responsible for what happens under your account. Tell us at the address below if you think someone else has used it.

Paid plans and packs are available only where Stripe Managed Payments supports the buyer and the transaction is lawful. New purchases are currently unavailable in Ascension Island, China, Cuba, Iran, Kosovo, North Korea, Russia, Syria, Tristan da Cunha. Stripe verifies purchase eligibility at checkout; sanctions, payment-method restrictions and regional rules can impose additional limits. A translated page does not promise that purchases are available in that country. Do not use another location or identity to bypass these restrictions.

Plans, trials and billing

The plans on offer today:

• Pro: $4.99 a week with 1,000 credits each week or $9.99 a month with 2,500 credits each month. New subscribers start with a 3-day free trial with 300 credits to use during it.

Base prices are in USD and exclude applicable tax. Regional prices shown with tax are estimates based on your location. Stripe may offer a local-currency price; the checkout total and currency are shown before you confirm. Stripe, through Link, is the merchant of record for these purchases and handles applicable sales tax, VAT and GST under its Managed Payments terms. We never see or store your full card number. Our configured descriptor is UPSCALE.TOOLS; Managed Payments charges may also identify Link. Your receipt identifies the seller and the transaction.

Your subscription renews automatically at the end of every billing period (each week or each month, as you chose at checkout), and the payment method on file is charged the plan's price for the next period until you cancel.

A free trial needs a card at checkout, and no subscription payment is charged during the trial. Unless you cancel before the trial ends, the subscription starts automatically when it ends and your card is charged the price of the plan and billing period you picked.

An eligible trial cancellation may receive a personal discount offer. Confirming that offer removes the scheduled cancellation and applies the stated percentage discount to every renewal for the remaining life of that subscription. The trial end date, plan and credit allowance do not change, and no subscription payment is taken when claiming during the trial. Offers expire before the trial ends, cannot be combined with other discounts and do not apply to credit packs or a new subscription after cancellation. Applicable tax remains additional. Ignoring or declining an offer does not undo a cancellation.

A trial is subject to eligibility checks and is offered once per person, account and payment card. Returning subscribers pay the selected plan price without a second trial. The price and trial eligibility are confirmed before checkout.

If a renewal payment fails, it may be retried. Cloud processing and new purchases pause while payment is overdue; balances are kept but cannot be spent. Update the subscription's payment method or complete the bank's confirmation from Settings, Plan & billing. If payment does not recover, the subscription may end.

If we change a plan's price, the new price applies to new subscriptions. We will tell you before a new price applies to a subscription you already have, and you can cancel before it does.

Credits

Paid plans come with credits, which cloud jobs use. Each time a renewal payment goes through, you get the plan's allowance for the new period, and the plan credits you did not use in the paid period that ended carry over, up to one period's allowance. Credits beyond that, and trial credits, do not carry over. Trial credits end when the trial ends and are replaced by the paid allowance after successful payment. Your account shows plan and purchased balances separately.

Subscribers may buy one-time packs: 1,000 credits for $4.99, 2,500 credits for $11.99, 6,000 credits for $24.99, 12,000 credits for $48.99, 25,000 credits for $99.99, before applicable tax. A pack is charged immediately, including during a free trial. Purchased credits do not expire and remain usable after cancellation, subject to account restrictions and storage limits. Plan credits are spent first, then purchased credits. There is no automatic top-up or overage payment: running out does not charge your card for a pack.

Images cost 10 credits per 16 megapixels of output, rounded up to the next 16 MP block. Video seconds are rounded up and cost 10 credits per second at 1080p or 40 at 4K, doubled above 30 frames per second. The job quotes and holds credits before processing; the final charge uses the actual output. Failed jobs return their held credits to their original pools; a return does not extend expired plan credits. A cancellation after a provider has started may retain its charge once the daily cancellation-refund limit is reached; the app tells you when a job cannot be cancelled for a refund.

Credits measure usage; they are not money and cannot be transferred, sold or exchanged for cash. Deleting your account removes its credits. Refunds and chargebacks reverse the associated credits and may leave a balance owing if those credits were already spent. Mandatory refund rights still apply.

Cancelling

You can cancel online at any time: open Settings, Plan & billing, then Manage billing to cancel in the Stripe customer portal. Link provides purchase support. A cancellation takes effect at the end of the current billing period. Until then your plan and its remaining credits stay available, and you are not charged again.

If you cancel during a free trial, the trial runs to its end and you are not charged. Plans and billing periods cannot be switched in the portal: to switch, cancel, then subscribe again once the current period has ended.

Cancelling an overdue subscription ends it immediately and stops further collection of its open invoices. If the online controls are unavailable, contact support using the help button or the email below. Cancelling renewal and asking to withdraw from a purchase or receive a refund are different requests.

Refunds

Payments are non-refundable for change of mind or unused periods and credits, except where mandatory law or Stripe's Managed Payments refund rules provide otherwise. Stripe may issue a refund under those rules even when our ordinary policy would not. Cancelling renewal alone does not request a refund of past charges.

Consumer cancellation, withdrawal and remedies for a faulty or misdescribed service remain intact. Consumers in the EU, EEA and UK normally have 14 days after the day an online service contract is agreed to withdraw without giving a reason, subject to applicable exceptions and any longer period required by law. Using credits does not by itself waive that right. Use our Withdraw from a contract form, Link's purchase support, or contact us through the help button or email with your account email, purchase date and a clear statement that you wish to withdraw. No particular form is required. We route purchase requests to Stripe and apply the mandatory rules for your location, including any required refund. This policy does not limit other non-waivable consumer rights.

For an eligible EU, EEA or UK service-contract withdrawal, reimbursement is made without undue delay and no later than 14 days after we are informed, using the original payment method unless you expressly agree otherwise, without a reimbursement fee. We do not treat accepting these terms or using credits as consent to give up withdrawal rights. Other local protections also apply, including Brazil's statutory seven-day withdrawal right for eligible distance purchases and Australia's consumer guarantees for services.

If you think we charged you by mistake, for example after you cancelled, email us at the address below and we will look into it. A charge made in error is refunded in full. You may also contact Link using your receipt. Contacting support does not restrict your right to dispute a charge with your bank.

Tips through the Support link are voluntary and buy no plan or credits. The tip provider's terms and any mandatory refund rights apply separately.

Acceptable use

Upscale only images you have the right to use. You are responsible for the images you upscale and for what you do with the results. You agree not to use Upscale.tools to:

• process sexual content involving minors, or anything else that is illegal to possess or share where you are. This is an absolute limit, and we report it to the authorities where the law requires;
• process intimate images of anyone without their consent, or images meant to harass, threaten or exploit someone;
• infringe anyone's copyright, trademark, privacy or other rights;
• create images meant to deceive, such as passing an upscaled image off as evidence or as an authentic record of something that did not happen;
• get around credits, limits or other technical controls, share an account, or drive the service with scripts as an automated or bulk service;
• resell, rebrand, frame or mirror the service;
• attack, overload, probe or interfere with the site, its systems or the people using it.

We may refuse a job, remove content, or suspend or close an account that breaks these rules, subject to any refund or other remedy required by law. You agree to cover us for any claim, loss or expense that comes from images you had no right to use, or from using the service against these terms.

Your images and results

You keep every right you have in the images you upscale, and the results are yours to use, subject to the rights of anyone else in the original. Upscaling while signed out happens on your device and gives us nothing.

When you are signed in, or send images to cloud processing, you give us a limited permission to store and process those images and their results and to show them back to you, only to provide the service. We do not sell them, share them except with the providers that run the service for us, or train any model on them. They stay until you delete them or close your account, as the Privacy Policy describes.

Our service

The site, its code, design and copy, and the Upscale.tools name belong to Elowin Labs LLC. The upscaling models belong to their authors and are used under their licenses. You may not copy, scrape or reuse the site or its content except as these terms allow.

Other services

Payments are handled by Stripe and sign-in by Clerk, under their own terms, and we rely on providers for hosting, email and analytics. We choose them with care, but we are not responsible for services we do not control, or for other sites we link to.

Disclaimers

THE SERVICE AND EVERY RESULT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT IT WILL WORK ON YOUR DEVICE, OR THAT ANY RESULT WILL MEET YOUR EXPECTATIONS. KEEP COPIES OF YOUR ORIGINALS.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, ELOWIN LABS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, IMAGES, PROFITS OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND ONE HUNDRED U.S. DOLLARS (US$100).

Some places do not allow these exclusions or limits. Where that is so, they apply only as far as the law allows, and nothing in these terms limits a right you have that cannot be waived.

Ending your use

You can stop using Upscale.tools at any time. Settings, Delete account removes saved files and credits and stops subscriptions immediately before deleting the account. This cannot be undone. Deletion does not itself request a refund. Limited billing and abuse-prevention records may remain as described in the Privacy Policy. Contact support if you cannot access your account.

We may suspend or close an account that breaks these terms, and we may change, limit or discontinue any part of the service. If we stop offering a paid plan, we will tell you in advance, it will not renew, and we will refund the unused part of any period you have already paid for.

Changes to these terms

We may update these terms as the service changes; the date below shows the latest change. If a change affects a paid plan you have, we will tell you by email before it applies to you. Using the service after a change means you accept it.

Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and the courts located in Palm Beach County, Florida have exclusive jurisdiction over any dispute. If you are a consumer living elsewhere, this does not take away the protection of the mandatory consumer laws where you live, or your right to bring proceedings there where the law gives you that right.
